Affordable Housing and Proposed 40B Projects


Mission

Chapter 40B, also known as the Comprehensive Permit Law, is a State statute that encourages the development of low- and moderate-income housing by providing a streamlined permitting process and relief from local zoning requirements. The preliminary step, prior to submitting a Comprehensive Permit application to the Zoning Board of Appeals, is to gain Project Eligibility/Site Approval from a Subsidizing Agency. In Medford, three projects (listed below) have been granted Project Eligibility by MassHousing and have filed a Comprehensive Permit application with the Board of Appeals.  At present, all three 40B project applications are on hold while the Medford Zoning Board of Appeals awaits a decision from the Massachusetts Housing Appeals Court on whether the City is eligible for “safe harbor” status from 40B applications.
